  • Mediation in the Criminal Procedure of Western States: Comparative Legal Analysis

    The purpose of this paper is to cover the theoretical component of the mediation mechanism, to determine its place in the criminal procedure, as well as to conduct a comparative analysis based on the practices of its functioning in various countries, namely the United States of America, Great Britain, Germany, France. The theoretical methodological approach, the formal legal methodological approach, the dogmatic methodological approach, the method of legal hermeneutics and others were used to conduct this study. The results of the study showed that at this stage the institution of mediation is quite young, but it is a fairly effective way of alternative dispute resolution; the study analysed the world practices of advanced states in the functioning of mediation, as well as their legislative norms that regulate this institution, considering the specific features of each of the legal systems
  • Theoretical and Practical Basics for Investigating Crimes in the Field of Money Laundering

    The purpose of the study is to consider the fundamentals of money laundering investigation, including problematic issues and development prospects, improving both the legal and procedural framework, which in the future would be able to use the tools obtained more effectively and get the most positive result. The main methodological approaches used to achieve the goals of this study are analytical and comparative, the second of which is based on comparing the achievements in the field of investigations by other states with a similar legal system, that is, international experience. The main results obtained are the designations of the main problems in the development of this part of criminal law, the identification of procedural gaps in the regulation of the work of investigative bodies, and the establishment of the main goals and objectives for the effective investigation of this category of crimes.
  • Role of virtual reality in advancing forensic medical examination in cases of occupational safety violations: a review

    This article discusses the prospects for introducing innovative technologies in the form of virtual and augmented reality when conducting forensic examinations of certain categories of criminal cases, such as violations of labor protection rules. Problematic aspects are revealed when conducting inspections of crime scenes in hard-to-reach areas with possible risks to people.Based on a generalization of scientific works and practical experience of foreign countries, the application of innovations in scientific and technological progress in forensic examinations were analyzed.The authors proposed an algorithm for conducting forensic examination in the field of labor protection using virtual reality technology, as well as its further application in legal proceedings. The proposed algorithm can serve as basis for the development of more effective and safe methods for conducting forensic examinations in virtual reality.The development of detailed 3D injury models that simulate real-life accident scenarios will enable more accurate and objective injury assessments. Moreover, compared to traditional forensics, the use of virtual reality technology ensures high accuracy of measurements and coverage of the entire object under investigation, significantly reduces operating time, and stores all received information in its original state, which is an excellent opportunity to recreate the scene of an incident in real time.The introduction of virtual reality into forensic examination in cases of violation of labor protection rules will contribute to efficiency, objectivity, completeness, and ensuring the reliability of not only the conclusions of forensic examinations but also legal proceedings in general. Additionally, this direction of technology development represents significant benefits for the judicial system, contributing to the reduction of time and fair trials in the field of labor protection and in other categories of criminal cases.

  • Identifying fake conclusions of forensic medical examinations using an artificial intelligence technology based on the experience in the Republic of Kazakhstan: a Review

    This review discusses the legal aspects on the use of mathematical statistics and machine learning (hereinafter referred to as artificial intelligence) in forensic activities to identify both expert errors and fake expert opinions. An attempt has been made to establish the criteria for evaluating conclusions of forensic examinations by determining their relevance, admissibility, reliability, and objectivity, as well as the objective possibility of distinguishing expert errors from deliberately false and fake expert opinions. A SWOT analysis on the use of artificial intelligence was carried out to solve the issue of its application in the field under consideration, which revealed its advantages, and disadvantages. The use of mathematical statistics and machine learning methods is not a universal method to identify fakes in expert opinions. However, given that this method can give both false-positive and false-negative results, its outcomes should be verified by independent experts. In addition, to effectively prevent the facts of falsification, comprehensive measures should be taken, including not only the detection of manipulations but also the prevention of the possibility of their occurrence, as well as the punishment of the perpetrators. Thus, this review proposed several amendments and additions to the current legislation of the Republic of Kazakhstan.
