  • Women’s Head Covering in Acehnese Tafsīr: Genealogical and Socio-Historical Readings of Two Vernacular Exegeses

    This article examines how women’s head covering is interpreted in Acehnese exegetical works across two centuries by comparing Tarjumān al-Mustafīd of ‘Abd al-Ra’ūf al-Fansūrī al-Singkilī (d. 1693) and Al-Qur’an al-Karim dan Terjemahan Bebas Bersajak dalam Bahasa Aceh by Tengku Mahjiddin Jusuf (d. 1994). Using a genealogical approach and social-historical reading, it traces the interpretive transmission and local adaptation of key Qur’anic terms related to female modesty—especially khimār/khumur, jalābīb, and juyūb—within Aceh’s shifting socio-political contexts. The analysis shows that Acehnese meanings of head covering are not fixed outcomes of the Qur’anic lexicon alone, but emerge through selective appropriation of earlier Sunni authorities and vernacularization into local dress-terms (e.g., telekung/sileukom and ija tob ulé). Social-historical comparison further indicates that al-Singkilī’s reading helped form an early interpretive horizon of female modesty in the period of royal governance, whereas Jusuf’s interpretation functions as a reinforcing discourse in a later setting no longer shaped by sultanate structures. Overall, the study clarifies how vernacular tafsīr operates as a mediating space where Qur’anic language, inherited exegetical authority, and local social practice continually reshape one another.
  • Social Labeling, Power, and Deviancy Amplification: Community Stigmatization of Migrant Residents in Adultery Cases in Banda Aceh

    Existing research on social labeling in adultery (zinā) cases in Aceh remains limited, particularly in exploring how local power dynamics shape processes of stigmatization. This article examines how the social labeling of migrant residents (ureung tamong) accused of zinā operates as a mechanism of social control that reinforces the dominance of local residents (asoe lhok), while media exposure intensifies stigma through deviancy amplification. Employing a legal anthropological approach, the article is based on three months of fieldwork in Banda Aceh, involving participant observation, in-depth interviews with ten key informants—including village authorities, community leaders, law enforcement officers, and local residents—and analysis of relevant online and social media content. The findings reveal that social labeling in zinā cases is driven not only by religious and customary norms but also by underlying community power structures, rendering ureung tamong significantly more vulnerable to public exposure and social sanctions than asoe lhok. Additionally, digital media exacerbates the amplification of deviance, resulting in prolonged social exclusion of individuals who have already faced customary or formal legal punishment. The persistence of digital records further obstructs their reintegration into society. This article contends that social labeling functions not merely as a tool of moral regulation but also as a strategy for maintaining the dominance of powerful groups within the community. It concludes by calling for more inclusive media practices and legal policies to prevent the prolonged social and psychological marginalization of individuals in zinā cases who have fulfilled their legal obligations. [Penelitian mengenai pelabelan sosial dalam kasus perzinaan di Aceh masih terbatas, khususnya dalam menelaah bagaimana dinamika kekuasaan lokal membentuk proses stigmatisasi. Artikel ini mengkaji bagaimana pelabelan sosial terhadap pendatang (ureung tamong) yang diduga melakukan zina berfungsi sebagai mekanisme kontrol sosial yang memperkuat dominasi penduduk lokal (asoe lhok), serta bagaimana eksposur media memperparah stigma melalui amplifikasi penyimpangan. Dengan menggunakan pendekatan antropologi hukum, artikel ini didasarkan pada kerja lapangan selama tiga bulan di Banda Aceh, yang meliputi observasi partisipatif, wawancara mendalam dengan sepuluh informan kunci—terdiri dari aparatur desa, tokoh masyarakat, aparat penegak hukum, dan warga lokal—serta analisis terhadap konten media daring dan media sosial yang relevan. Temuan menunjukkan bahwa pelabelan sosial dalam kasus zina tidak semata-mata dipengaruhi oleh norma agama dan adat, tetapi juga oleh struktur kekuasaan di dalam komunitas, sehingga ureung tamong jauh lebih rentan terhadap eksposur publik dan sanksi sosial dibandingkan asoe lhok. Selain itu, media digital memperburuk amplifikasi penyimpangan, yang berujung pada pengucilan sosial berkepanjangan terhadap individu yang telah menjalani sanksi adat maupun hukum formal. Keberadaan jejak digital yang terus bertahan semakin menghambat proses reintegrasi sosial mereka. Artikel ini menegaskan bahwa pelabelan sosial berfungsi tidak hanya sebagai alat regulasi moral, tetapi juga sebagai strategi untuk mempertahankan dominasi kelompok yang berkuasa di dalam komunitas. Oleh karena itu, penelitian ini merekomendasikan adanya kebijakan media dan hukum yang lebih inklusif guna mencegah marginalisasi sosial dan psikologis yang berkelanjutan terhadap individu dalam kasus zina yang telah menjalani sanksinya.]
  • RESHAPING ISLAMIC KNOWLEDGE, ADVOCATING WASAṬISM: The Azharites and the Transformation of Urban Religious Learning in Banda Aceh, Indonesia

    This article examines the significant role of the Azharites (Al-Azhar alumni) in reshaping Islamic knowledge alongside the transformation of urban religious learning in Banda Aceh over the past two decades. The study highlights their contributions to disseminating Islamic knowledge through platforms like the Middle East Alumni Association (Ikatan Alumni Timur Tengah—IKAT), advanced reading communities, mosques, coffee shops, and mass/social media. They have facilitated public learning in classical Islamic knowledge, such as tafsīr, taḥsin al-Qur’an, ḥadīth, fiqh, uṣūl al-fiqh, ʿaqīdah, sīrah, and mawārith by introducing not only basic and intermediate but also advanced religious texts. Furthermore, the Azharites have promoted also Wasaṭism (wasaṭiyyah, moderation) in the understanding of Islam, rooted in Shafi'ite-Ash'arite traditions, while incorporating texts from other madhhabs, such as the Hanafite, Hanbalite, and Malikite schools, in comparative way. Their approach distinguishes them from both the strict madhhabism and the anti-madhhabism of Salafi-Wahhabism and radical Islamism. The study concludes that the Azharites have contributed to the discursive democratization and reform, which have resulted in the reshaping of Islamic knowledge in Banda Aceh—and Aceh province in general—and the moderation of madhhabism, by introducing Wasaṭism and fostering alternative urban religious learning.
  • MUDA WALY AL-KHALIDI (1917-1961): PESANTREN, TARIQAH, AND POLITICS OF RELIGIOUS AUTHORITY IN ACEH

    This study explores the life and contributions of Muda Waly al-Khalidi (1917–1961), a prominent Acehnese ulama who played a crucial role in shaping Islamic education, Sufi practices, and ulama politics of religious authority in Aceh. Muda Waly was instrumental in advancing the Ahlussunnah wal Jama'ah (Aswaja) theological tradition and propagating the Naqshbandiyya Khalidiyya tariqa.Naqshbandiyah Khalidiyah tariqa. He founded the Darussalam Islamic boarding school (pesantren) in Labuhanhaji, which became a significant center for Islamic learning in Aceh. His efforts also extended into politics through his involvement with Persatuan Tarbiyah Islamiyah (PERTI), a traditionalist Islamic organization countering modernist influences. Using Foucault’s genealogy approach, this study examines the intellectual and religious formation of Muda Waly, tracing his educational lineage in Sumatra and Mecca, his engagement in theological debates, and his role in shaping Aceh’s religious landscape. I argue that the legacy of Muda Waly al-Khalidi represents an intricate process of knowledge formation and power relations in Aceh’s religious landscape. His establishment of pesantren, propagation of the Naqshbandiyya Khalidiyya Sufi order, and resistance to modernist movements illustrate the genealogical development of religious authority. His contributions demonstrate how religious authoritytraditions are continuously reshaped through negotiation, appropriation, and resistance. Future studies could further explore how his epistemic legacy continues to evolve in response to emerging theological and political contestations in Indonesia.
  • NEGOTIATING THE PAST-IMAGINING THE FUTURE The Qur’an and the Ritual of Saminism

    This paper investigates how far the Qur’an penetrated into the ritual of Samin people in Central Java. Taking their conversion to Islam and the politics of religion as point of departure, this paper argues that the attempts of Samin people to negotiate their previous belief to the present involve their unique interpretation of the Qur’an in their religious tradition. For the young Saminist it is a strategy to shape new morality and materiality of being a Muslim. The present ritualistic tradition among Saminist then comes up with complexity; it is by maintaining the locality and adopting the new element for their ritual. Such negotiation was due to massive political project of santrinization in contemporary Indonesia and vast decline of abangan community. In this context, the Qur’an and the produced religious ritual at certain tradition among Saminist are discursive in which the Samin community rationalize the new ritual based on their understanding about Islam rooted on their historical narrative.
  • The Existence of Non-Muslim Minorities in Aceh Indonesia: A Study of Civil and Police Institutions

    The implementation of Islamic law in Aceh had impact for the existence of non-Muslim minority groups. Even though they are guaranteed freedom to worship, harmony and protected, and can live side by side with the Aceh society, on the other hand, they are also feeling the impact of sharia. These implications are experienced by Christian women, not only among civil groups, but also police institutions. This article aims to complement the shortcomings of previous research, by mapping the relationships that existed between Muslim and non-Muslim groups in Aceh during the implementation of Islamic sharia. The research question is, how do these implications occur and why public space is limited for them. This research was conducted in Banda Aceh involving six informants and some were women, civil society groups and several police institutions, namely three Christian policewomen, through in-depth interviews and using several references related to the research subject. The results of the study indicated that, first, there are social spaces that have an impact on non-Muslim groups because they live in areas of Islamic sharia that require them to receive these regulations, such as the obligation to wear the veil for students, teachers and policewomen in police agencies. Then, there are limited facilities for worship, including for policewomen to provide spiritual guidance. Apart from that, there is little access to public space in government, which occurs among non-Muslim minority children who would like to develop their talents, as well as employees and in police agencies who could not develop their careers perfectly. This happens because they cannot have opportunities like the people of Aceh who are the "hosts". In this case, the government must be able to harmonize laws, including for minority groups in Aceh. It is hoped that the results of this research could adding references regarding the importance of increasing awareness and fostering the values of tolerance.

  • Legal Reasoning on Paternity: Discursive Debate on Children Out of Wedlock In Indonesia

    This article explains why Indonesian Ulama and Islamic jurists who oppose the Constitutional Court decision have failed to see the progressive norms in Islam and human rights. They argued that the decision determining that the children born out of wedlock have filiation not only with their mother but also with their father contrasted to and has no legal basis in Islamic jurisprudence. Therefore, this paper will provide the rationale of the arguments of Islamic jurists, including Indonesian ulama, and the proponent of the Indonesian Constitutional Court decision. In conclusion, Indonesian ulama and Islamic jurists have been embracing the conservatism point of view, that is static and textual thinking in interpreting the Ḥadith concerning the issue of a child out of wedlock. As a result, they did not accept another interpretation. Other interpretations are delivered by classical Islamic jurists like Ibn Taimiyyah and Ibrahim al-Nakhā'ī, who argued that a child out of wedlock has a civil relationship with their parents. Meanwhile, the proponent of the Indonesian Court decision adheres to the progressive point of view that considers the children's public interest. Artikel ini menjelaskan mengapa para ulama dan ahli hukum Islam Indonesia yang menentang keputusan Mahkamah Konstitusi (MK) telah gagal melihat norma-norma progresif dalam Islam dan hak asasi manusia. Mereka berargumen bahwa keputusan yang menetapkan bahwa anak yang lahir di luar nikah memiliki hubungan nasab tidak hanya dengan ibunya tetapi juga dengan ayahnya bertentangan dan tidak memiliki dasar hukum dalam yurisprudensi Islam. Oleh karena itu, makalah ini akan memberikan dasar pemikiran dari argumen para ahli hukum Islam, termasuk ulama Indonesia, dan pendukung keputusan Mahkamah Konstitusi Indonesia. Kesimpulannya, para ulama dan ahli hukum Islam Indonesia selama ini menganut pandangan konservatisme, yaitu pemikiran yang statis dan tekstual dalam menafsirkan hadis tentang masalah anak di luar nikah. Akibatnya, mereka tidak menerima penafsiran lain. Padahal, ada penafsiran lain disampaikan oleh para ahli hukum Islam klasik seperti Ibnu Taimiyyah dan Ibrahim al-Nakhā'ī, yang berpendapat bahwa anak di luar nikah memiliki hubungan keperdataan dengan orang tuanya. Sementara itu, pendukung putusan MK menganut pandangan progresif yang mempertimbangkan kepentingan umum-anak-anak.
  • Reinterpreting the first pillar of the nation: (Dis)continuities of Islamic discourses about the state ideology in Indonesia

    The article analyses discourses of Islamic actors in Indonesia about the state ideology Pancasila (lit. Five Pillars). It discerns three discursive positions that exist in Indonesia since its independence, namely full acceptance of Pancasila as the state ideology, complementing Pancasila with Islamic law, and outright rejection of Pancasila and its replacement by (political interpretations of) Islam. Having a particular focus on the post-Suharto era (since 1998), the article compares more recent discourses with the ones from earlier phases in Indonesia’s post-colonial history indicating discursive (dis)continuities. It is particularly concerned with reinterpretations of the first pillar of the Pancasila, that is the belief in the One and Only God, that is today used by conservative and Islamist figures to call for the implementation of Islamic law. The article argues that this indicates a major shift in discursive positions, as the rejection of Pancasila and its complementation with Islamic law have become increasingly illegitimate views. Under present political conditions in Indonesia, the article concludes, the only position that is left for the Islamist camp is to accept Pancasila as it is and to combine it with a reinterpretation of the first pillar as guarantor for the implementation of Islamic law.
  • Forbidden visibility: Queer activism, shari'a sphere and politics of sexuality in aceh

    This article aims to explain why organized queer activism emerged in Aceh, but could endure only in about six years (from 2008 to 2014). It is argued that this has mainly caused by massive expansion of ‘shari‘a spheres’ since 2001 supported by national and local government and parliament legal-political back up and societal religio-cultural forces on the one hand, and weak nature of the queer movements as counterpublics, characterized with the inadequate resources mobilization, especially in leadership and in getting support from its social movement communities during the crises on the other hand. Shari‘a, which is heteronormative, have been used as discursive and embodied disciplinary power of sexuality for normalizing and excluding the queer (including lesbian, gay, bisexual, and transgender/LGBT). Their organized visibility triggered the issuance of the Qanun Jinayah in 2014, which includes punishment for same-sex activities. It caused them to dissolve their own queer organizations.
