Divergent Jurisprudential Paradigms of Productive Zakat: A Madhhab-Based Comparative Study of Legal Reasoning in LAZISNU and LAZISMU Ending Solehudin, Idzam Fautanu, Hisam Ahyani, Mowafg Masuwd Mazahibuna Jurnal Perbandingan Mazhab, 2026 This study examines productive zakat not merely as a managerial instrument for economic empowerment, but as a manifestation of contemporary Islamic legal ijtihād (independent legal reasoning) shaped by divergent jurisprudential paradigms. Situated within the framework of comparative madhhab studies, this research analyzes how differences in legal reasoning between LAZISNU—rooted in the Shāfiʿī legal tradition—and LAZISMU—characterized by a reformist approach grounded in tajdīd (renewal) and tarjīḥ (legal preference)—influence the formulation and implementation of productive zakat practices in Indonesia. Employing a qualitative juridical-empirical method, the study draws on in-depth interviews with zakat administrators and institutional documents from LAZISNU and LAZISMU operating in Java and Bali. The findings reveal that the transformation of zakat from consumptive distribution to productive utilization is legitimized through distinct modes of istidlāl (legal reasoning or inferential deduction), wherein LAZISNU emphasizes adherence to authoritative Shāfiʿī doctrines, particularly concerning the principle of tamlīk (transfer of ownership to beneficiaries), while LAZISMU adopts a more flexible form of ijtihād that prioritizes maqāṣid al-sharīʿah (the higher objectives of Islamic law) and socio-economic outcomes. This divergence reflects an ongoing dialectic within contemporary Islamic legal thought regarding the boundaries of zakat utilization. By integrating empirical practices with cross-madhhab legal analysis, this study contributes to the development of comparative fiqh al-zakāt (Islamic jurisprudence of zakat) and demonstrates how modern philanthropic institutions negotiate classical legal doctrines within heterogeneous socio-legal contexts such as Java and Bali.
FROM CHARISMA TO ACADEMIC RATIONALITY: An Ethnographic Study of “Academic Kiai” Leadership in Indonesian Pesantren Mowafg Masuwd, Yoga Irama, Zayad Abd. Rahman, Moh. Asror Yusuf, Najah Baroud Miqot Jurnal Ilmu Ilmu Keislaman, 2026 <p class="ABSTRAKISI"><span lang="IN">This study explores Kiai Sanuri’s leadership as an “academic <em>kiai</em>” at Pesantren Sholahuddin Surabaya, focusing on how his approach reshapes the cultural foundations of a traditional Islamic boarding school. Employing an ethnographic qualitative design, the research draws on in-depth interviews, participant observation, and institutional documents. The findings show that Kiai Sanuri has cultivated an integrative leadership model that brings together charismatic religious authority, participatory governance, and academically grounded management. Leadership practices are expressed through structured decision-making, strategic planning informed by evidence, and the deliberate integration of scientific literacy into everyday pesantren life. These efforts have strengthened organisational professionalism, expanded educational networks, enhanced academic standards, and repositioned santri as active contributors to knowledge. The study suggests that the “academic <em>kiai</em>” model offers a credible and contextually grounded framework for pesantren leadership in navigating contemporary educational and social change.</span></p><p class="ABSTRAKISI"> </p>
Historical Development of Islamization in the Nusantara: Trends and Scholarly Contributions Muhammad Choirin (Corresponding Author), Mowafg Abrahem Masuwd, Muhammed bin Yusof, Hakimuddin Salim, Hasan Basri Tanjung Journal of Al Tamaddun, 2025 This study conducts a comprehensive bibliometric analysis of the historical trajectory of Islamization in the Nusantara, with a focus on tracing key scholarly contributions and academic trends over time. By applying advanced bibliometric methods, this research systematically examines a broad array of academic literature, identifying seminal works, prominent authors, and influential periods that have shaped the discourse surrounding Islamic propagation and its integration into the cultural fabric of the region. The findings highlight significant trends in the evolution of da’wah strategies, the roles of diverse actors in the dissemination of Islam, and the socio-political dynamics that have influenced these processes. Furthermore, the study offers a critical assessment of the implications of these academic patterns for contemporary da’wah efforts, suggesting that an understanding of historical scholarly contributions can enhance the relevance and effectiveness of modern da’wah initiatives. This bibliometric approach not only enriches the academic landscape of da’wah and Islamization studies but also provides a nuanced framework for future research, contributing to a more profound understanding of the Islamic historical and intellectual legacy in the Nusantara.
Shariah in Action: Assessing the Impact of Jinayat Law on Social Order in Aceh Bastiar Bastiar, Bukhari Bukhari, Anwar Anwar, Iswandi Iswandi, Mowafg Abrahem Masuwd Justicia Islamica, 2025 This research aims to examine in depth how the application of Qanun Jinayat in Aceh affects the dynamics of social order in the community. With a qualitative approach based on case studies, this study explores the perceptions of various community groups including religious leaders, law enforcement officials, and vulnerable groups to understand the effectiveness, challenges, and social impacts of the implementation of sharia-based law. Data was collected through in-depth interviews, field observations, and focus group discussions in four strategic areas of Aceh, and then analyzed thematically with the help of ATLAS.ti software. The results of the study show that although the jinayat law contributes to a reduction in moral offenses such as gambling and alcohol consumption, its implementation is not uniform and still faces various obstacles, both technical, social, and legal. Concerns about discriminatory treatment of women and minority groups are also a major concern. Therefore, it is recommended that there be harmonization between qanun and national law and the strengthening of protection for vulnerable groups, so that the application of this law can take place fairly and inclusive in order to maintain social stability in Aceh.
Legal Politics of Restricting Access to Online Gambling in Fiqh Siyasah and Saddu adz-Dzariah Perspectives Syarifuddin Syarifuddin, Elvi Soeradji, Imam Alfiannoor, Aris Sunandar Suradilaga, Mowafg Abrahem Masuwd Nurani, 2025 This research examines how online gambling poses serious threats to the stability and cohesion of family life. Regardless of the individuals involved, its influence often results in psychological harm such as addiction, job loss, family breakdown, indebtedness, and even criminal behavior. These issues call for in-depth examination through normative legal methods combined with real-time case studies, highlighting online gambling as a current and pressing legal issue. This study employs the framework of fiqh siyasah alongside the principle of saddu adz-dzari'ah to guide its analysis. From a legal-political perspective, some argue that Indonesia could legalize online gambling to increase state revenue through entertainment taxes. However, this perspective contradicts the principles of siyasah maaliyah within fiqh siyasah, which emphasizes that state income should align with both worldly and spiritual welfare. Accordingly, siyasah dusturiyah underscores the importance of preventing the potential harms (mafsadat) associated with online gambling, in line with the principle of saddu adz-dzari'ah, to protect the integrity of families in Indonesia.
Overcoming Intellectual Unemployment through Entrepreneurship Learning Transformation: A Case Study on Sharia Economic Law Study Program of Unismuh Makassar Fakhruddin Mansyur, Jasri Jasri, Mowafg Masuwd Al Muamalat, 2024 The number of job vacancies in Indonesia is still far less than the number of job seekers every year. This shows the inability of both the government and companies to create job opportunities for generation Z in Indonesia and at the same time emphasizes that educational institutions are not able to create an easy generation that is careful about entrepreneurship, even though the level of young entrepreneurs is one of the benchmarks of a developed country. The aim of this research is to find a formula for increasing the entrepreneurial spirit of Generation Z through effective entrepreneurship learning. The type of research used is field research with a quantitative approach. The object of this research is students and graduates of the Unismuh Makassar Sharia Economic Law Study Program. The results of this study indicate that of the two variables studied, namely human resources in this case are lecturers (X1) and entrepreneurship learning (X2) it is known that the variable X1 does not influence the growth of student entrepreneurial spirit while entrepreneurship learning has a positive and significant effect on growth. student entrepreneurial spirit. So, it can be concluded that to build and foster the entrepreneurial spirit of students there needs to be improvement and great attention to the entrepreneurship learning process which is capable of being a means of creating Generation Z who are fond of entrepreneurship.
MUHAMMAD ABDUH AND SUFISM: BUILDING SPIRITUAL CONSCIOUSNESS IN THE CONTEXT OF SOCIAL CHANGE Moh. Nor Ichwan, Mowafg Masuwd, Mokh. Sya'roni, Naser Ali Abdulghani Teosofi Jurnal Tasawuf Dan Pemikiran Islam, 2024 This article examines Muhammad Abduh's role in utilizing Sufism to build spiritual consciousness amid significant social changes in Egypt in the late 19th century. The main issue discussed was how Abduh combined the teachings of Sufism with social reform in the context of modernity, which is increasingly developing due to the influence of European colonialism and modernization pioneered by Muhammad Ali Pasha. This study explores how Abduh positioned Sufism as a moral tool supporting social reform. The method used is text analysis of Abduh's works and relevant secondary literature studies. The main findings show that Abduh has successfully integrated the spiritual dimension of Sufism with the demands of modernity, making Sufism a pillar to strengthen public morality and support harmonious social change. This article strongly recommends that further studies be conducted to understand how Abduh's approach to Sufism can be applied in contemporary social contexts that face similar challenges, as this could provide valuable insights for addressing current societal issues.
SUFISM AND QURANIC INTERPRETATION: Bridging Spirituality, Culture, and Political Discourse in Muslim Societies Moh. Nor Ichwan, A. Hasan Asy'ari Ulama'i, Mowafg Abrahem Masuwd, Naser Ali Abdulghani Ulumuna, 2024 This research discusses the influence of the Sufi interpretation of the Qur'an in shaping cultural narratives and political discourses in Muslim society. This study addresses the under-explored influence of Sufism beyond its spiritual domain, specifically in cultural and political spheres. This study aims to fill this void by exploring how the Sufi interpretation of the Qur'an influences contemporary cultural identity and political dynamics. The methods used in this study are multidisciplinary approaches, including analysis of Sufi literature, art, and social practices. The study's findings suggest that Sufism has a significant role in shaping cultural narratives, promoting tolerance and social justice, and providing a framework of thought that influences political discourse in Muslim communities. This study recommends that future studies focus more on Sufism's contribution to Islamic political thought and its relevance in the modern context. This research also emphasizes the importance of considering the spiritual dimension in analyzing cultural and political phenomena to understand the role of religion in shaping the social and political landscape more comprehensively.
Understanding of Legal Reform on Sociology of Islamic Law: Its Relevance to Islamic Family Law in Indonesia Ahmad Zayyadi, Ridwan, Arif Hidayat, Ubaidillah, Mowafg Abrahem Masuwd Al Manahij Jurnal Kajian Hukum Islam, 2023 This article analyses the understanding of legal modernization in the sociology of Islamic law in Muslim countries regarding Islamic family law in Indonesia. The theory of legal modernization arises from the long history of Islamic legal theory since the Dutch era related to the enactment of Islamic law, both in terms of the struggle between customary law, Islamic law, and state law. The work for the emergence of legal theories such as Receptie theory becomes a filter for Islamic law in its application to Muslim communities in Indonesia. The results of this study indicate that the modernization of law in the form of KHI applies to the Indonesian Muslim community and requires the nation to be more mature in responding to modernity. However, there is an intersection between modernization and legal secularisation in the Islamic world, such as in Turkey, Egypt, Sudan, and Syria. Legal modernization from fiqh towards positivisation has given birth to formulations in Islamic family law in the form of sociological dynamics in contemporary Indonesian Islamic society.
