Regulatory Gaps in Protecting Children's Constitutional Rights against Digital Microtransactions in Indonesia's Online Gaming Ecosystem Isharyanto, Achmad Fawaid, Ismail Marzuki Khazanah Hukum, 2026 This article examines regulatory gaps in protecting children’s constitutional rights against digital microtransactions in Indonesia’s online gaming ecosystem. The study aims to analyze how monetization mechanisms such as loot boxes, gacha systems, pay-to-win designs, and other persuasive interfaces may expose children to risks of digital economic exploitation; to evaluate the adequacy of Indonesia’s legal framework in addressing those risks; and to formulate a child-centered regulatory model for online gaming governance. This research employs normative legal methods through doctrinal, comparative, and conceptual approaches. The doctrinal approach is used to examine Indonesian positive law, the comparative approach analyzes regulatory responses in the United Kingdom, the Netherlands, South Korea, and Japan, and the conceptual approach interprets constitutional protection and the principle of the best interests of the child. The findings show that digital microtransactions function as integrated monetization architectures that may exploit children’s cognitive, behavioral, and social vulnerabilities. Although Indonesia already possesses relevant legal instruments, including Article 28B paragraph (2) of the 1945 Constitution, the Child Protection Law, the Consumer Protection Law, the ITE Law, and Government Regulation No. 17 of 2025, the current framework remains fragmented, general, and insufficiently responsive to microtransaction-specific risks. The study implies the need for a child-centered regulatory framework based on design protection, transparency obligations, platform accountability, and coordinated institutional supervision. The originality of this article lies in repositioning digital microtransactions from a predominantly psychological and market-based issue into a constitutional child-rights issue within Indonesia’s digital legal order.
Human Intelligence and Algorithmic Precision: An Experimental Study of Indonesian Translation Pedagogy in Higher Education Achmad Fawaid, Ridhatullah Assya’bani, Irwan Abdullah, Chusnul Muali, Moh. Syadidul Itqan, et al. Asian Journal of University Education, 2025 This study examines the effectiveness of integrating human intelligence and algorithmic precision in Indonesian translation pedagogy. The research aims to determine whether human-led or machine-assisted translation methods lead to better outcomes for students in terms of translation accuracy and cultural comprehension.A quasi-experimental design was employed, involving 60 students divided into control and experimental groups. The control group used machine translation tools, while the experimental group relied on human translation. The study also included a textual analysis that evaluated the translations based on grammar, vocabulary, sentence structure, cultural relevance, and idiomatic expressions. The results indicated that human translations consistently outperformed machine-assisted translations, especially in culturally nuanced and idiomatic expressions. The quasi-experimental findings further showed that students who engaged in human-led translation demonstrated greater improvement in translation skills. These results suggest that while machine tools offer speed, human intelligence remains crucial for deep linguistic and cultural understanding. The study highlights the importance of a blended approach in translation pedagogy, combining both human and algorithmic tools.
Islamic Law And Gendered Inheritance: An-Taradhin as Breakthrough for Women’s Rights Disputes in Java, Bali, and Sumatra Hendi Sugianto, Achmad Fawaid, Hasan Baharun, Ayuningtias Yarun Al Istinbath Jurnal Hukum Islam, 2025 The Indonesian government provides legal protection for women, but they face ongoing challenges in preserving land ownership in various regions. This article aims to explore three main points: (a) women’s contested land ownership and inheritance rights in Java, Bali, and Sumatra, (b) the successful breakthroughs in the application of Islamic law in addressing these contestations in other regions, and (c) the idea of an-taradhin as a practical solution to these disputes. This study employs a qualitative empirical legal research approach, combining documentary analysis of statutory frameworks and Islamic legal sources with field interviews with several stakeholders (ranging from PPAT to NGOs). The empirical data were gathered through fieldwork in selected rural communities across Java, Bali, and Sumatra. This dual approach integrates normative legal analysis with empirical findings to offer a contextualized understanding of the application of Islamic law. This study reveals that Islamic laaw, when contextualized with local customs, offers a viable framework to overcome cultural and legal barriers. Notably, the principle of an-taradhin demonstrates potential to uncover the issue of women’s land and inheritance rights amidst legal and customary conflicts in Indonesia. This study also recommends breakthroughs by providing some lessons from other cases of implementing an-taradhin in various regions (such as in the Sundanese, Sampang, and Yoruba communities). This study contributes primarily to Islamic legal studies with significant implications for customary law reform and gender justice, by proposing the integration of Sharia-based principles such as maslahah and an-taradhin within pluralistic legal systems.
The Ambiguous Authority of Provincial Governors in Customary Law Recognition: Regulatory Fragmentation in Indonesia’s Decentralization Era Rizki Jayuska, I Gusti Ayu Ketut Rachmi Handayani, Isharyanto Isharyanto, Ismail Marzuki, Achmad Fawaid Khazanah Hukum, 2025 This study aims to analyze the structural, institutional, and regulatory challenges in recognizing Indigenous Law Communities (Masyarakat Hukum Adat/MHA) in Indonesia, with a particular focus on the strategic yet ambiguous role of provincial governments. Despite the legal mandate for decentralization, the dual function of governors as regional heads and central government representatives has not been supported by a clear legal framework to facilitate cross-district recognition of MHA. Using a qualitative approach, the study employs document analysis of legal texts, regional regulations, and case studies, supported by secondary data from institutional reports and scholarly publications. The findings reveal three major issues: first, the absence of a legal mandate for governors to coordinate inter-district recognition processes; second, regulatory conflicts between provincial and district-level authorities, especially when indigenous territories cross administrative boundaries; and thrid the lack of harmonization between regional customary regulations and national laws. These obstacles have resulted in legal uncertainty, fragmented policy implementation, and continued marginalization of indigenous communities. This research contributes to the discourse on multilevel governance by emphasizing the overlooked role of governors in indigenous rights recognition. It also identifies practical entry points for policy reform, such as enhancing judicial review mechanisms, formalizing adat institutions, and improving spatial data integration across ministries. The originality of this study lies in shifting the analytical lens from district-level actors to the provincial level, proposing a coordinated, vertically and horizontally integrated governance framework for sustainable recognition of indigenous communities in Indonesia.
THE Visual Representation in the 2024 Indonesian Presidential Campaign Irwan Abdullah, Dedy Afriadi, Mirna Yusuf, Mikke Susanto, Achmad Fawaid Visual Review International Visual Culture Review Revista Internacional De Cultura, 2025 This research explores the significant role played by visual representation in Indonesian presidential election campaigns. By addressing a gap in existing literature that has largely overlooked the importance of visual representation in shaping voter preferences, this study contributes to a deeper comprehension of the underlying dynamics. Through the analysis of visual data, it becomes apparent that effective visual representation has the potential to enhance a candidate’s image, sway voter emotions, and ultimately impact electability. Key findings highlight variations in communication strategies employed by presidential candidates, emphasizing the crucial role of visual representation in political campaigns and the complex array of factors influencing public decision-making. The dominance of visual communication emerges as a critical factor in shaping public opinion and determining voter preferences. This study provides scholarly insights into the mechanisms involved in visual communication within political processes, particularly within the context of leadership campaigns.
Visualizing inequality: uncovering gender bias in Islamic textbooks of Indonesia Achmad Fawaid, Putri Handayani Cogent Education, 2025 The issue of gender bias in educational materials, especially within Islamic textbooks extensively used in Indonesia, remains a crucial yet insufficiently examined topic despite its profound impact on shaping students’ understanding of gender roles. This study examines gender bias in visual materials of Islamic textbooks for grades 1 to 12 published by the Ministry of Education and Culture. To achieve this goal, this study uses a qualitative approach comprising content analysis, interviews, and Focus Group Discussions (FGD) to collect and analyze data. The study’s results indicate following: a) Islamic textbooks in Indonesia reflect broader trends in Muslim-majority countries, underrepresenting women and reinforcing gender stereotypes; b) visual content exhibits four patterns: underrepresentation, stereotypical portrayals, objectification, and a lack of diversity; c) the production process of textbooks is dominated by men, with 83.3% of primary authors and 91.7% of reviewers being male, perpetuating structural inequalities; d) interviews show students and teachers often overlook gender stereotypes but recognize their impact when prompted; e) ideological power embedded in textbook production sustains traditional gender norms, limiting critical discourse; f) FGD highlights strategies for reform, such as increasing women’s participation in content creation and ensuring equitable visual representations. This study emphasizes systemic reforms to address gender stereotypes in textbooks, contributing to a gender-sensitive educational framework that promotes equity and inclusivity.

E-Portofolio in Improving Critical Thinking and Self-Management through Lesson Study: A Study on Writing Pedagogy in Higher Education Achmad Fawaid, Putri Handayani, Yahya Aulia Abdillah Proceedings International Conference on Education and Technology ICET, 2024 The purpose of this study was to investigate the effectiveness of integrating e-portfolios with the Lesson Study approach in enhancing critical thinking and self-management skills among higher education students in writing pedagogy. The research was conducted in a quasi-experimental design, involving two classes with a total of 53 students. One class employed traditional portfolios, while the other used e-portfolios, both within the context of Lesson Study cycles. Data were collected through pretests and posttests assessing critical thinking and self-management skills, supported by qualitative observations from the Lesson Study. The results indicated that the use of e-portfolios, when combined with Lesson Study, significantly improved both critical thinking and self-management skills compared to traditional portfolios. Based on the ANACOVA test results, F-value of critical thinking and self-management skill is 9.841 and 10.84 with significance level of 0.002. It indicates that there is a statistically significant effect of the method (e-portfolio vs. traditional portfolio) on critical thinking and self-management skill after controlling for the pretest scores. Even though Lesson Study based e-portfolio has many advantages, this study still has limitations, namely its short duration and single institution, it still provides opportunities for future research on a wider scale.
The Role of Online Game Simulation Based Interactive Textbooks to Reduce at-Risk Students' Anxiety in Indonesian Language Subject Achmad Fawaid, Irwan Abdullah, Hasan Baharun, Siti Aimah, Riza Faishol, Nur Hidayati 2024 International Conference on Decision Aid Sciences and Applications Dasa 2024, 2024 This study investigates the effectiveness of online game simulation-based interactive textbooks in reducing anxiety and improving concept comprehension among at-risk high school students studying Indonesian. The research employs a quasi-experimental design with 70 participants, divided equally into experimental and control groups. The experimental group utilized the interactive textbook, which integrates game elements and real-life scenarios, while the control group received traditional classroom instruction. Data were collected using the Test Anxiety Inventory (TAI), written tests, and an open-ended questionnaire to assess students' anxiety levels, concept comprehension, and learning experiences. The results indicate that students in the experimental group showed a significant reduction in anxiety, particularly those with high and moderate levels of pre-existing anxiety. Additionally, the experimental group demonstrated greater improvement in concept comprehension compared to the control group. These findings suggest that integrating game simulation-based interactive textbooks can enhance learning outcomes by creating a supportive and anxiety-reducing environment, thus addressing both cognitive and emotional aspects of education. The implications highlight the need for incorporating such digital tools in educational settings to foster a holistic approach to student learning.
