- Legal Controversy Over Divorce Filed by Wives in Religious Courts in Indonesia
Titin Samsudin, Mualimin Mochammad Sahid, Arhjayati Rahim, Putri Ananda Saka
Samarah, 2025
Divorce initiated by a wife is often a source of controversy within religious courts. In line with that, three questions are answered in this paper. First, what is the form of the "controversy" in the normative and juridical legal considerations of cerai gugat or divorce initiated by a wife; (b) what is the form of the legal impact in the judge's decision on the "controversy" of a contested divorce; (c) what is the form of the "controversy" in community life on the response to a contested divorce. This study is a sociological study of law using a case study approach in religious courts. Data were collected by analyzing court decisions, journal articles, and books, then analyzed using Islamic legal theory. The results of this study indicate that there are three levels of controversy surrounding divorce initiated by wives. First, the differences that occur in normative and juridical law regarding the incompatibility between Islamic law and positive law governing divorce lawsuits by wives cause controversy in the law of divorce at the request of wives in religious courts. Second, differences in judges' decisions in the law of divorce initiated by a wife. It causes controversy and resulting in legal impacts from various aspects. Third, the controversy over the response of community leaders. Some religious and community leaders see it as a threat to the stability of the family and the long-established social order. In contrast, others see it as a form of women's freedom to determine the direction of their own lives. In the context of Islamic law, the decision of a religious court is binding and enriches the development of sociological studies of law, especially divorce initiated by the wife, and influences social and legal change in Indonesia. - THE DRAMATURGY OF DA’WAH FOR RELIGIOUS COMMUNICATORS IN MUSLIM MINORITY COMMUNITIES

Jurnal Ilmiah Peuradeun, 2025
Da’wah strategies continue to evolve in collaboration with societal trends and receptivity. A dissonance between societal developments and the methods of religious propagation may result in the rejection of religious messages and strained interactions between majority and minority groups. Therefore, a more contextualized approach is required to enhance the effectiveness of da’wah. This study explored dramaturgical da’wah as a strategic framework employed by religious communicators to convey religious messages through frontstage and backstage performances. Utilizing a qualitative methodology, data were collected through interviews and observations of Muslim minority preachers on Nias Island. The findings demonstrated that da’wah practices were implemented by following dramaturgical principles, engaging audiences differently across stages. The success of this strategy was influenced by segmented communication methods, cultural adaptation to local traditions, and the portrayal of Islam as peaceful and open to interfaith dialogue. This approach contributed to fostering interreligious harmony and sustaining the presence of Muslim minorities in Nias. The study offers a novel perspective, highlighting that the development of da’wah strategies must consider the field of experience, particularly in regions where Muslims are a minority. - Aesthetic Transformation of Javanese Wayang Performances in the Digital Era

This study examines how technological advancements have transformed the aesthetics of wayang performances in Java. Data collection methods include observations of wayang performances, interviews, literature reviews, and internet searches to capture the aesthetic transformation of wayang performances in the digital age. Given the existing literature’s tendency to discuss wayang performances within a limited scope, this research provides a more comprehensive contribution by positioning wayang performances as an integrated entity encompassing dalang creativity and audience response. Through the analysis of diverse wayang performances, the study demonstrates that aesthetic transformation is evidenced by the dalang’s hybrid presentation techniques, the emergence of novel story repertoires, and increased audience engagement. Significant findings from this study include the growth of dalang’s creative and adaptive capabilities, enhanced interpretative approaches in composing wayang stories, and the audience’s influence in shaping mass aesthetic trends. This study provides important contributions to the pedalangan (puppetry) and the relations of wayang, dalang, audience, and technology. Furthermore, this study contributes to the academic discourse on cultural adaptation in the digital age and provides pragmatic resources for the artistic development of Javanese puppetry. - Dis-implementation of the Islamic Family Law in Fulfilling the Rights of Ex-Wives After Divorce in Indonesia

Humanities Arts and Social Sciences Studies, 2024
Bedhahan or the facial features of shadow-puppets play a crucial role in maintaining the quality of performances. However, the shortage of skilled practitioners in this field has raised concerns among artistic communities. The difficulty of finding proficient shadow-puppet face sculptors calls for thorough investigation and resolution of the problem, yet has not received adequate attention in earlier studies. Therefore, this study seeks to address two fundamental questions: (1) What are the reasons for the shortage of shadow puppet face sculptors?; and (2) What are the implications of this shortage for the world of performing arts? To answer these questions, this study employs a qualitative research approach, focusing on a comprehensive case study that involves both the sculptors engaged in puppet making and the puppeteers. The research methodology encompasses a series of site visits and observations at prominent centers of puppet-making, followed by in-depth interviews with shadow puppet sculptors and puppeteer. Additionally, insights from community figures with extensive knowledge and experience in puppet-making processes and puppet usage are also incorporated into the research. The findings reveal several contributing factors to the lack of shadow puppet face sculptors. These factors include the demanding and intricate learning process, the need for sustained patience during puppet face sculpting, and the specialized skills required for this unique art form, which not all puppet makers possess. This study underscores the paramount importance of safeguarding the knowledge and expertise of shadow puppet sculpting, particularly Bedhahan, to ensure the preservation and continuation of puppet performances. The responsibility for preserving this rich tradition should not solely rely on society; it should also emcompass the active involvement of relevant institutions. By addressing these challenges and promoting the training and appreciation of shadow puppet face sculptors, the cherished art of Bedhahan can endure, sustaining the cultural significance and artistic brilliance of performances for future generations. - Economic empowerment of unbanked women through financial inclusion in Indonesia

This study aims to elucidate the economic empowerment of unbanked women within the National Pension Savings Bank (BTPN) Sharia, focusing on the role of financial inclusion. It investigates how enhanced access to financing impacts the income and savings of the womenfolk operating home-based businesses in West Sumatra, Indonesia, using a qualitative methodology to delve into the empowerment pattern of unbanked women at BTPN Sharia. Data collection consisted of in-depth interviews and questionnaires, sourced from various stakeholders, such as customers, community officers, and BTPN Sharia leaders, followed by a thorough qualitative and descriptive analysis. The findings showed that the economic empowerment of unbanked women, driven by financial inclusion, is achieved through an initial membership training program consisting of financial literacy, management, and savings. This program also offers convenient access to financing and subsequent assistance, all conducted in a participatory manner referred to as ‘baropok’, where women gather in a circle, facing the community officer. The financial inclusion-based empowerment model, emphasizing easy access to financing, has a positive impact on the income and savings of women engaged in home industry businesses in West Sumatra. These findings hold significant implications for the academic discourse on the economic empowerment of unbanked women within the framework of financial inclusion in Islamic Commercial banks. - The Reinforcement of the ‘Dowry for Groom’ Tradition in Customary Marriages of West Sumatra’s Pariaman Society

Samarah, 2023
In contrast to the customary mahar or dowry system in typical Indonesian marriages, West Sumatra's Minangkabau people in Pariaman practice a unique ‘dowry for groom’ tradition, in which the bride pays a dowry to the bridegroom based on his social status. Payment is adjusted according to the social status of the man and is a must for the marriage to take place. This paper aims to examine the persistence and strengthening of the ‘dowry for groom’ tradition in the Pariaman Muslim community in West Sumatra by focusing on three main issues, namely the practice of ‘dowry for groom’ in the Pariaman community; factors that make the ‘dowry for groom’ tradition survive among Pariaman Muslims in the midst of the swift currents of modernization and globalization; and the mechanism of social reproduction of the 'dowry for men' tradition in the Pariaman community. The study is an empirical legal research using sociological theory as an analytical tool. Data is collected through interviews, observation and literature studies. The findings reveal that the reinforcement of the 'dowry for groom' tradition in Pariaman society is supported by several fundamental factors, including the widespread practice and support from the community, religious and traditional leaders, the local government, and the younger generation. The 'dowry for groom' tradition in Pariaman reflects the values of Muslim identity, such as adherence to religious teachings by finding husbands for daughters and maintaining a spirit of mutual aid, while also protecting the Minangkabau institution of ninik mamak (elders) and strengthening women's position as the true "monarchs" in Minangkabau society. Further research could explore more extensive meanings related to the 'dowry for groom' tradition
